First off, this is a marketing campaign. This means we will do the following things:

1. Send out a tweet on your behalf when you send in a nomination
2. Add you to AKTA's general email list as well as a specific email list for this contest
3. Automatically follow @weareakta on your behalf

If you do not want any of these things to happen, DO NOT SEND IN A NOMINATION OR VOTE!

CRITERIA TO BE ACCEPTED

1. Only EXISTING products are eligible. You must have a living breathing app, website, twitter, et.
2. You must be in the United States (sorry, legal crap)
3. Your product must be a web, mobile, tablet, touchscreen, kiosk or television APPLICATION!. Once more, it must be an actual application. Marketing sites and other non-apps are not eligible.
4. You must be fun to work with :)

NO PURCHASE NECESSARY TO ENTER OR CLAIM PRIZE. OFFERED ONLY IN THE 50 UNITED STATES AND DISTRICT OF COLUMBIA (“U.S.”) AND OPEN ONLY TO LEGAL U.S. RESIDENTS WHO ARE 18 YEARS OF AGE OR OLDER.

ELIGIBILITY: NO PURCHASE NECESSARY TO ENTER OR CLAIM PRIZE. Open to legal residents of the 50 United States and District of Columbia who are 18 years of age or older at time of entry. Employees of AKTA Web Studio LLC (the “Sponsor”), its subsidiaries, licensees, agencies, affiliates and members of the immediate families (spouses and parents, siblings, children and their spouses and in-laws) and persons living in the same household of such individuals (whether related or not) are not eligible. Entrants may be subject to rules imposed by their employers relative to their participation in trade promotions and should check with their employer for any relevant policies. Void where prohibited by law or internal business or company policy.

TO ENTER: Eligible Entrants must, during the Entrance Period: Complete their Entry Form (available at www.freeux.com) (providing all details required, including a Twitter handle that has at least fifty (50) followers attached to the account, their Name of Product, Product URL, Email address of Product Team, Product Type, and description for “Why should this product be nominated”). Entrance Period will begin March 13, 2012, at 9:00 a.m. (CST) and will end on April 15, 2012 at 7:00 a.m. (CST).

By submitting an entry, entrants thereby represent and warrant that the submitted work or information does not and shall not infringe on any copyright, any rights of privacy or publicity of any person, or any other right of any third party, and the entrants the right to grant any and all rights and licenses granted to the contest sponsors herein, including but not limited to, all necessary rights under copyright, free and clear of any claims or encumbrances.

TO VOTE: Voting participants may cast votes for a prize winner with a valid Twitter account (“valid” refers to the account having at least fifty (50) followers) on www.freeux.com. Each valid Twitter account can cast up to five (5) votes for Eligible Entrants of their choice. Only one (1) vote may be cast by participating Twitter accounts for each Eligible Entrant. Twitter accounts may not cast more than one vote for each Eligible Entrant. Voting on Eligible Entrants will begin on April 15, 2012, at 10:00 a.m. (CST) and will end on May 31, 2012, at 5:00 p.m. (CST).

PRIZES On June X, 2012, AKTA Web Studio, LLC will choose the winning submission based on the list of Eligible Entrants with the most votes. Prizes include:

Up to twenty five thousand dollars ($13,700) of user experience design and web design consulting will be provided to the winning entry. Prize amount will begin at an amount of $10,000. Prize amount will increase by $50 for each nomination accepted within the Entrance Period with a maximum prize amount of $13,700 to be awarded based on the total amount of Eligible Entrants accepted. Total prize amount will be determined based on the the number of eligible entries received.

The total prize amount will be awarded based on AKTA Web Studio LLC providing resources at a rate of one hundred fifty dollars ($150) per resource. AKTA Web Studio LLC will negotiate with the winner to determine how the Prize amount will be rewarded. The maximum amount of resource hours provided to the winner will be capped at two hundred (200) hours, as determined by AKTA Web Studio LLC. The winner of the contest may be required to enter into a Professional Services Agreement with AKTA Web Studio LLC prior to the beginning of any service offerings. The schedule of service, type or nature of services provided, and means of delivery of services will be at the sole discretion of AKTA Web Studio LLC.

Winners will be contacted via email at Sponsor’s sole discretion. If a winner cannot be reached within 90 days of initial attempt, winner will be disqualified and an alternate winner selected. Odds of winning will be determined by the number of eligible entries received.

GENERAL: Taxes on prizes and all expenses not specified related to acceptance and use of prizes are the sole responsibility of winners. By participating in (the “Promotion”), entrants agree (a) to these rules and decisions of Sponsor which shall be final in all respects relating to the Promotion; (b) to release and hold harmless Sponsor, its subsidiaries, affiliates and agencies, and their respective directors, officers, employees, agents and representatives from any and all claims, demands, costs, expenses, liability, losses or damages of any kind resulting from their participation in the Promotion or their acceptance, use or misuse of a prize, including liability for personal injury or death; and © if a winner, to the use of name and/or photograph for advertising and publicity purposes without compensation (unless prohibited by law) and agree to execute specific consent to such use. Winners may be required to complete an Affidavit of Eligibility and Liability Release and (where legal) Publicity Release and an IRS Form W-9, which must be returned within the time period specified by Sponsor or an alternate winner may be selected. Return of any prize/prize notification as undeliverable may result in disqualification of winner and selection of an alternate winner. Sponsor, its officers, directors, affiliates, subsidiaries, agents and representatives and their respective employees are not responsible for (a) any electronic, hardware or software, program, network, Internet or computer malfunctions, interruptions, disconnections, miscommunications, failures, or difficulties of any kind, including, without limitation, server malfunction or by any human error which may occur in the processing of entries; (b) failed, incomplete, garbled or delayed computer transmissions, and © any condition caused by events beyond the control of the Sponsor that may cause the promotion to be disrupted or corrupted. Persons who tamper with or abuse any aspect of the Promotion or website or act in violation of these Official Rules will be disqualified, at Sponsor’s sole discretion. Sponsor reserves the right in its sole discretion to cancel or suspend the Promotion or any portion thereof for any reason whatsoever. No prize transfer. No prize substitution except by Sponsor due to unavailability, in which case a prize of comparable or greater value will be awarded. Sponsor is not responsible or liable for late, lost, illegible, damaged or misdirected entries. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed to be submitted by the person in whose name the email account is registered at the time of entry. Potential winners may be required provide evidence that winner is the authorized account holder of the email address associated with a winning entry. In no event will Sponsor, its subsidiaries, affiliates and agencies, and their respective directors, officers, employees, agents and representatives be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of your access to and use of the internet site http://www.freeux.com/ or other sites promoting the Promotion or the downloading from and/or printing material downloaded from said sites. Without limiting the foregoing, everything on this site is provided “as is” without warranty of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement. Entries become the property of Sponsor. No prize transfer. No prize substitution except at Sponsor’s sole discretion.

AKTA WEB STUDIO LLC AND CONTEST PARTNERS ARE NOT LIABLE FOR: (i) late, lost, delayed, or stolen prizes; (ii) any injuries, losses or damages of any kind caused by any prize or resulting from the acceptance, possession or use of such prize, or from participation in the Free UX contest; or (iii) any printing, typographical, administrative or technological errors in any materials associated with the Free UX contest. The Free UX contest Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Free UX contest, and reserves the right, in its sole discretion, to cancel, modify or suspend the Free UX contest should a virus, bug, computer problem, unauthorized intervention or other causes beyond AKTA Web Studio LLC's control, or otherwise, corrupt the administration, security or proper play of the Free UX contest. In such event, AKTA Web Studio LLC may in its discretion post notice on the Free UX contest web page and implement an alternative means for awarding the prizes. AKTA Web Studio LLC may prohibit any Entrant or Voter from participating in the Free UX or winning a prize if, in its sole discretion, it determines an Entrant or Voter is attempting to undermine the legitimate operation of the Free UX contest by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other Creators or the Contest Sponsor representatives. AKTA Web Studio LLC reserves the right in its sole discretion to suspend, modify or terminate this Free UX in any manner it deems necessary and reasonable. AKTA Web Studio LLC shall not be responsible if the Free UX contest cannot be implemented or if a prize cannot be awarded due to delays or interruptions due to acts of God, acts of war, strikes, governmental action, natural disasters, weather or acts of terrorism. Any and all disputes, claims, and causes of action arising out of or in connection with the Free UX contest, shall be resolved individually, without resort to any form of class action. Prizes are not redeemable for cash.
